The Ministry of Education and Sports has issued a notice regarding the publication of delegated legislation under the Delegated Legislation Act, 2081. The ministry states that laws, rules, directives, regulations and standards issued under previous legal authority but not yet published in the Nepal Gazette must be registered with the Ministry of Law, Justice and Parliamentary Affairs within one year of the Act coming into force.
The notice includes a list of 19 delegated legal documents registered by the ministry and its subordinate bodies. These include regulations and directives related to laboratory risk management, the National Forensic Science Laboratory, CTEVT employee service and examination rules, curriculum and textbook development, student learning facilitation, educational information management, secondary education equivalence, educational quality testing, language teaching, National Examination Board employee rules, girls’ and inclusive education, targeted scholarships, school social audit and school infrastructure construction.
The ministry has also clarified that any delegated legislation not issued or registered according to the provisions of the existing Act will be considered automatically invalid as per Section 35(2) of the Delegated Legislation Act, 2081.
